Why will this fail?
You are trying to register the domain product.tld and delegate it to
ns1.subsidiary.company.tld and ns1.subsidiary.tld nameservers.
If the two nameservers exist in the registry and the domain is available
then the add domain command will succeed.
For "using" a nameserver for delegating a domain, "ownership" of the parent
domain of the nameserver is not required. It is only when you are trying to
add a new nameserver in the TLD for which the registry is authoritative, it
is required that the parent domain of the nameserver be already registered
in the registry and "owned" by the registrar adding the nameserver in that
parent domain.
